Terms of Service

Entity: Nispax ("We", "Us", or "Our")

These Terms of Service govern your access to and use of the Eclipse Launcher Service (the "Service") provided by Nispax. By accessing or downloading the service, you agree to be bound by these terms.

Pre-Release Notice

Eclipse Launcher is currently in active development (alpha). These Terms of Service are subject to change upon the official launch of the launcher. You will be notified of any significant updates. Continued use after changes constitutes acceptance.

1. The Service

1.1. Service Description: Nispax provides an independent Minecraft launcher utility. The Service acts as a technical shell to launch game files and manage modifications.

1.2. Relationship to Mojang: This Service is entirely independent. Nispax is NOT affiliated with, endorsed by, or associated with Mojang AB or Microsoft Corporation.

1.3. Third-Party Hosting: The Service includes a server directory. Nispax may receive referral commissions from third-party providers. Nispax is not responsible for the performance or financial transactions of these third parties.

2. Data Research & Analytics

2.1. Usage Collection: The Service collects anonymized usage data (e.g., click patterns, version preferences, and performance metrics).

2.2. Purpose: Currently, this data is used for internal performance monitoring. Nispax reserves the right to utilize this data in the future for aggregated research, community trend reporting, or sharing with strategic partners to improve the ecosystem.

2.3. Anonymity: Nispax guarantees that research data is stripped of personal identifiers. We do not collect or store your game passwords or private credentials.

3. Liability and User Responsibility

3.1. Use at Your Own Risk: Use of the Service and any runtime modifications (e.g., brand-spoofing, custom auth) is strictly at the user's own risk.

3.2. No Guarantee: Nispax disclaims all liability for data loss, account bans, or system damage resulting from the Service or third-party mods.

4. User Obligations

4.1. Compliance with Laws: Users are solely responsible for ensuring they possess the necessary rights and licenses to access the game files loaded through the Service.

4.2. Prohibited Activities: Users shall not use the Service to distribute malicious software or engage in unauthorized commercial activity.

5. Intellectual Property

5.1. Ownership: The Eclipse Launcher software, UI, and code are owned by Nispax.

5.2. Game Assets: Minecraft game assets and core code remain the intellectual property of Mojang AB.

6. Modification and Termination

6.1. Access Changes: Nispax may update, terminate, or restrict access to "Offline" or "Custom Auth" modes at any time to ensure compliance with legal frameworks or third-party updates.

7. Limitation of Liability

7.1. Liability Cap: To the maximum extent permitted by law, the aggregate liability of Nispax and its Directors shall not exceed ₹1.00.
